Another Win in the Appellate Division

Our judgment enforcement practice spans many areas of substantive law, including commercial, real estate, and personal injury matters. Occasionally we represent litigants in matrimonial cases, who are owed substantial sums of money by their ex-spouses.

This brings us to the remarkable Dimitri Sogoloff, a reputed financier who obstinately refused to pay his ex-wife monies owed in the delayed equitable distribution of an investment in a tech company. Rather that remit half of the funds when the investment ripened, the scheming Dimitri, who had remarried, used all of the funds from the investment and all of his other assets to purchase a luxury $3 million co-op apartment off Central Park West, which was titled in joint name with his new wife, who contributed nothing to the purchase. This made Dimitri, now an unemployed house husband, judgment proof and placed the entire co-op unit beyond the reach of his ex-wife’s large money judgment.

Or so Dimitri thought. We sued to set aside Dimitri’s transfer of funds into the co-owned real estate asset as a fraudulent transfer. A lower court judge mistakenly dismissed the case, but this month we won a solid and unanimous reversal. Sogoloff v. Sogoloff, 2025 NY Slip Op 00069 (1st Dep’t January 7, 2025). We Are Hired to Enforce a Huge Judgment Against a Real Estate Investor

It’s always exciting to be retained to enforce a large judgment, especially when the referring lawyers are from a major New York law firm. We have received numerous referrals from our colleagues at large law firms over the years and are honored by their confidence in our abilities.

The latest is a biggie: a judgment for $21 million against a New York-based real estate investment company with assets throughout the United States, plus a separate judgment for $22 million against the personal guarantor of the same debt. It is a complex matter with many moving pieces, but we are already making good progress, including summarily defeating an attempt to delay an execution sale and winning a motion allowing us to credit bid at the execution sale. Our work is ongoing.
